An Israeli company, a large international supplier of aviation spare parts and ground equipment, as well as a contractor for repairing aircraft equipment, approached us on the issue of suing the economic court against the largest producer of agricultural equipment in Belarus.
Firm’s role on the case
Clients’ claims arose from a concluded foreign trade contract for the supply of fasteners: after the proper delivery of the goods, the debtor did not fulfill his obligation to pay for the goods to our client.
Description
Our lawyer Danila Smolsky conducted oral pre-trial negotiations with the debtor regarding the fulfillment of obligations under the foreign trade agreement with the sending of a pre-trial claim, which subsequently led to a partial repayment of the transaction debt. However, to recover the full amount of the debt, one still had to go to court.
Before filing a package of documents with the court, Danila Smolsky correctly determined the jurisdiction, which caused certain difficulties due to the ambiguity of the reflection of this issue in the contract. A full package of court documents was also prepared, translated into the language of the proceedings and duly legalized in accordance with international rules.
As a result of the work, the court ruled in favor of our client on the full satisfaction of the claims.
As a result of the actual execution of the court decision, an amount of more than 36,000 US dollars was transferred to the client’s bank account, including the main debt, interest and expenses related to the payment of lawyers.
